CAIR-Michigan Files Federal Suit Against City of Troy

I received notice on 11/8/18 from Troy City staff that the Michigan chapter of the Council on American-Islamic Relations (CAIR-MI) filed a lawsuit on behalf of the Adam Community Center against the City of Troy, the City of Troy Planning Commission, the City of Troy Zoning Board of Appeals; Daniel Agauas, Glen Clark, Thomas Desmond, David Eisenbacher, Orestis Kaltsounis, Padma Kupa, Dave Lambert, and James McCauley, individually and in their official capacities as Members of the Troy Zoning Board of Appeals.

According to the CAIR-MI news release:
"The lawsuit alleges that the City of Troy has purposefully and unconstitutionally attempted to keep a Muslim community from building a mosque within the city by unfair and illegal application of zoning ordinances."
Most recently, the Adam Community Center had a hearing in front of the Zoning Board of Appeals on 6/19/18. Since I was not in attendance at that meeting, I did not post information on it to this blog. But, since that June 2018 meeting is now the subject of a lawsuit, I'm posting the City's YouTube video below.

Troy Zoning Board of Appeals - October 2018 Meeting Recap

City staff has posted the video recording of the 10/16/18 Troy Zoning Board of Appeals (ZBA) meeting to YouTube. At the bottom of this post is the video.

There were two items on the agenda. Action taken on each item is listed below.
  • 1321 Boyd. "A variance to allow the property to be split into two 7,200 square foot parcels, where the Zoning Ordinance requires each new parcel to be 7,500 square feet."

    The ZBA voted to deny the variance request. I voted yes on the motion to deny the variance.

  • 3876 Fadi. "A variance to allow a proposed sunroom addition to the house to be 37 feet from the rear property line. The Zoning Ordinance requires the addition to be 45 feet from the rear property line."

    The ZBA voted to postpone action on this item to our November meeting.
